מעשים מגונים בילדים – חומרת העבירה

עבירות המין המנויות בחוק העונשין מתייחסות בכל עבירה לשני מקרים: עבירת מין המבוצעת בבגיר ועבירת המין המבוצעת בקטין. ביצוע העבירה בקטין מהווה נסיבה מחמירה – דהיינו, העונש על אותה העבירה יגדל כאשר היא מבוצעת בקטין. 'קטין' בניסוח העבירה מהווה נסיבה / עובדה שיש להוכיח אותה. כלומר, יש להוכיח כי המבצע ידע שהקורבן הוא קטין לעתים אף ועשה את המעשה בקטין בגלל היותו קטין. נושא זה יכול להיות אחת הנקודות שבה יטפל עורך דין פלילי.

קטין הוא כל מי שטרם מלאו לו 18 שנה, ובעבירות מין ישנה הפרדה בדרך כלל בין קטין עד גיל 14 ולאחר גיל 14. כאשר מדובר בקטין מתחת לגיל 14 – מדובר בעבירה חמורה יותר. הסיבה נעוצה בעובדה כי קטין מתחת לגיל 14 לא יכול לתת הסכמה למעשה ו/או להבין את השלכות המעשה. לכן, העבירה שנעשתה בו נעשתה תוך ניצול של תמימותו, חוסר הבנתו, נטיית הקטין הרך לא להתנגד וכדומה.

בעבירת המעשה המגונה (סעיף 348(ד) לחוק העונשין) ישנה התייחסות לביצוע עבירת מעשה מגונה בקטין שטרם מלאו לו 14 שנים תוך ניצול יחסי מרות, תלות, השגחה או שירות – דהיינו על ידי מי שהקטין ראה בו דמות אחראי או דמות מרות ומי שתפקד ככזה, למשל: מדריך, מאמן, מורה וכדומה.

מתחם הענישה בעבירות אלה

עבירות מסוג מעשה מגונה מחולקות למספר קטגוריות:

• מעשה מגונה בפומבי – אינו חייב לכלול מגע בקורבן אלא מספיק שעשה המבצע מעשה מיני בעצמו מול אדם אחר או מספר אנשים, ובכך ביצע עבירת מין.
• מעשים מגונים ברף הגבוה יותר של העבירה – כשאלו נעשים באחר ולעתים תוך שימוש בכוח. בין אלו ישנה ההבחנה אם נעשה המעשה בקטין.

מתחם העונש נע בין עבודות שירות לחודשי מאסר. ככל שהמעשה חמור יותר וכולל שימוש בכוח או נעשה בקטין, כך הנטייה של בית המשפט תהיה לפסוק עונש מאסר מאחורי סורג ובריח.

כיצד יכול עורך דין פלילי לסייע לנאשם במקרה זה?

תפקידו של עו"ד פלילי בעבירות אלה הוא לבחון את חומר הראיות, לבחון אם המעשה נכנס תחת ההגדרה 'מעשה מגונה' ו'עבירת מין', לבחון אם ידע או לא ידע המבצע כי ה'קורבן' הנו קטין ומה טיב המעשים, מה הגורם לעשייתם. כמו כן יש לבחון לא פעם את העדויות שניתנות כנגד המבצע. לא בהכרח אלה תמיד עקביות ולעתים אף מביעות הגזמה בתיאור המעשה.
