שימוע פלילי לחשודים בלינץ' באזרח האריתראי: סיכוי למנוע כתב אישום?

האם יש סיכוי למנוע כתב אישום פלילי?

הליך שימוע פלילי לפי סעיף 60א לחוק סדר הדין הפלילי הנו הליך מהותי ולא טכני בלבד. בית המשפט העליון עמד על כך פעמים רבות בעודו יוצק פרשנות להוראת הסעיף על חובת היידוע של חשוד כי חומר החקירה הועבר לפרקליטות לצורך בחינתו ושקילה אם להגיש כנגדו כתב אישום. במסגרתו של הליך שימוע, בדרך כלל יקבל עורך דין פלילי המייצג את החשוד את חומר החקירה, או לפחות את ליבת חומר החקירה – דהיינו את הראיות המרכזיות בתיק עליהן הוא מבוסס על מנת שיוכל לבחון את החומר ולטעון טענות מהותיות, משמעותיות ובעלות ערך בפני הפרקליטות.

במסגרת ההליך, יכול להצביע עו"ד לשימוע על חולשת הראיות, על חוסר אינטרס ציבורי בהעמדה לדין וכדומה. בכך יכול להשפיע השימוע הפלילי על ההחלטה אם להעמיד לדין או אם לאו. פעמים רבות נמנעת העמדה לדין של אדם בעקבות שימוע שנערך טרם הגשת האישום. פעמים רבות השימוע מוביל לכתב אישום פחות בחומרתו – ואף להגעה להסדר טיעון מוצלח בין הצדדים.

אילו טענות יכול לטעון עורך דין פלילי בשימוע?

עו"ד פלילי, במהלך השימוע, יכול להצביע על מחדלי חקירה קשים החותרים תחת האישום, על חוסר בראיות טובות, על חולשת ראיות ואף על ראיות המצביעות על אי אשמתו של החשוד או כאלה המעמידות אשמתו בספק. כמו כן, יכול לטעון עורך הדין הפלילי לכך כי העמדה לדין במקרה הספציפי הזה לא משרתת את האינטרס הציבורי. במקרה דנן, לבטח יטען עו"ד פלילי מטעם החשודים על הראיות המיוחדות במקרה הספציפי, המצביעות על חוסר כוונת זדון לפגוע באדם חף מפשע, על ראיות התומכות בטענת ההגנה העצמית וכאלו אשר יצדיקו הימנעות מאישום פלילי.

מעורבותם של אנשי השב"ס במעשים לכאורה

העובדה כי המדובר באנשי שב"ס, בדרך כלל דורשת אמות מוסר ומידה גבוהות, ואלה דווקא בדרך כלל מטות לחובתם את הכף, מכיוון שבעת ביצוע העבירה הם למעשה מועלים באמון הציבור ובנאמנותם לגוף שבו הם משרתים, ובכך יש לצבוע את המעשה בחומרה יתרה.
