שופטת בית משפט השלום, דנה עופר, קיבלה את דברי סנגורו של החשוד והסבירה שהחשד כנגדו נמוך מאוד. לכן, דחתה את בקשת המשטרה להארכת המעצר והורתה לשחרר את החשוד למעצר בית.

שתי הסוגיות שעולות מתיק זה

הסוגיה הראשונה שעולה הנה 'חשד סביר'. חשד סביר הוא רף נמוך הנדרש לצורך מעצרו של אדם לחקירה. המשמעות שלו היא שישנן אינדיקציות הקושרות את החשוד לביצוע העבירה, אך אלה לא חייבות להיות אינדיקציות הבאות לידי ביטוי בראיות חד משמעיות. מספיק שאלה מעוררות חשד סביר, שכל אדם / שוטר בנסיבות העניין היה קושר בין החשוד לעבירה ברמה הראשונית. את החשד הסביר יש לבחון ולבדוק והדבר נעשה במסגרת החקירה, בה קיימת לחשוד זכות להיות מיוצג על ידי עורך דין פלילי. ככל שהחשד מתגבר, כך נקשר אותו חשוד בביצוע העבירה ומאומת על ידי ראיות אובייקטיביות. ככל שנחלש החשד, הרי שהדבר משפיע על המשך מעצרו של החשוד ומגדיל את הסיכוי לשחרורו.

הסוגיה השנייה היא ראיות מסוג טביעות אצבע. טביעת אצבע נחשבת לראיה מדעית בעלת מהימנות גבוה. ישנה הנחה ולפיה אם נמצאה טביעת אצבע של חשוד בזירת העבירה, ישנו קשר בינו ובין העבירה, אלא שחזקה זו ניתנת לסתירה, כלומר ניתן להתמודד איתה על ידי טענות המסבירות את עצם הימצאותה של טביעת האצבע בזירה. ככל שטענות אלה הגיוניות ואפשריות, כך עוצמתה של ראיית טביעת האצבע נחלשת.

כמו במקרה דנן, טביעת אצבע על מנורה, כשההסבר הוא שהחשוד עזר לאחר להעביר לבית את המנורה, היא הגיונית, ככל שיתר הגרסה של החשוד הגיונית אף היא וסותרת ראיות אובייקטיביות אחרות. כך למשל נסתרה הטענה כי הוא גר בבית שבו נמצאה המעבדה. מאחר שטביעת האצבע נמצאה רק על המנורה ולא בשום מקום אחר הקשור בקשר ישיר והדוק יותר לסם, כגון על השתילים או על הסם עצמו, כשהוא ארוז למשל בשקית, כך החוזק של ראיית טביעת האצבע קטן.

ואם החשוד לא היה מיוצג על ידי עו"ד פלילי?

במקרה שלפנינו היה מיוצג החשוד על ידי עורך דין פלילי. במקרה כגון זה ובכלל, חשוב להתייעץ עם עורך דין כבר בשלב החקירה. חשוב שהחשוד ימסור את גרסתו כבר במשטרה ויספק הסבר אמין לטביעת האצבע. חשוד שלא יודע מהן ההשלכות של הראיות המוטחות בו, עלול לסבך את עצמו אפילו בשתיקתו.
