על שחרור חשוד בעבירות סמים ממעצר בשל רשלנות

עיתוי המעצר לא מצדיק את שלילת חירות החשוד

כמי שמייצג בתיקי סמים כעורך דין פלילי, ישנה חשיבות גדולה כבר בשלב המעצר, להביא בפני בית המשפט חוות דעת משטרתית, כי אכן מדובר בסם. מבלי להקל ראש בחומרת העבירות המיוחסות לחשוד, לשלילת חירותו של אדם לתקופה ארוכה כל כך, מבלי לבחון את טענותיו ואם אכן מדובר בסם, ישנה משמעות. לכן, העובדה שהמעצר בוצע בחג שלאחריו ימי שישי ושבת, אינה מצדיקה את שלילת חירותו. על המשטרה להיערך במקרים אלו לביצוע בדיקות מעבדה לצורך דרישת הארכת המעצר, ולא לבקש אותה מבית המשפט כאשר היא 'אינה מוכנה'.

בתוך כמה זמן מחויבת המשטרה לבדוק את הטענות?

כחלק מתפקידה של המשטרה לחתור לחקר האמת, היא מחויבת לבחון את טענות החשוד, שכן טענות אלה הנן גרסתו ויש בהן, אולי, להסיר ממנו את החשד. יודגש כי בשלב המעצר הראשוני מדובר בחשד ופעולות המשטרה אינן להדביק את החשד לחשוד, אלא לחתור לחקר האמת ולבחון כל כיוון סביר – בין היתר בחינת טענות החשוד שהן הראשונות במעלה.

אי בחינת טענות החשוד, אם יוגש כתב אישום כנגדו, יכול לשמש בסיס לטענה מהותית של מחדל חקירה אשר ככל שזו תהיה מבוססת וחזקה יותר אף יכולה להוביל לזיכוי וליצירת ספק סביר. על עורך דין פלילי לזהות בזמן את אי בחינת הטענות ולהציג אותו בפני בית המשפט, בדיוק כפי שנעשה כאן.

את טענות החשוד יש לבחון בתוך זמן סביר מתוך ימי המעצר אשר הוטלו עליו, זאת, כפי שצוין לעיל, מאחר שבחינת טענות אלה, יש בהן על מנת להסיר חשד מאותו חשוד ובכך לקצר את מעצרו ולמנוע פגיעה חמורה בחירותו.

משמעות שחרור החשוד לביתו

באופן עקרוני, כדאי לרוב להגיע למשפט כאדם חופשי ומשוחרר, אף אם תחת תנאים מגבילים כלשהם. בשחרור בתנאים יכול נאשם (לאחר הגשת כתב אישום פלילי) להשתלב בהליכים טיפוליים או להשתלב בעבודה ולהוכיח לבית המשפט כי ערך שינוי בחייו, אשר לכול לסייע רבות בגזירת העונש כטענה להקל בעונשו. במקרה דנן, המדובר במעצר ימים, כלומר מעצר לצורכי חקירה, ומכאן ועד להגשת כתב אישום הדרך עוד רחוקה, אלא ששחרור ממעצר ימים בהכרח מסייע לחשוד, שכן המדינה תתקשה לבקש את מעצרו עד תום ההליכים באם יוגש כנגדו אישום – מכאן שככל הנראה יתנהל ההליך כשהוא משוחרר, אף אם משוחרר תחת תנאים מגבילים.

ומה אם החומר שנמצא הוא סם?
